By accessing or using Swappka ("the Service"), you confirm that you have read, understood, and agreed to these Terms. If you do not agree, stop using the Service.

2. Description of Service

Swappka is a platform that allows users to list items and connect with others for swaps. Swappka does not own, inspect, verify, or guarantee any items. Swappka is not a party to any transaction between users and does not participate in swaps. The Service provides only a technological space for communication.

3. User Responsibilities

Users agree to:

  • Provide accurate and truthful item descriptions
  • List only items they legally own
  • Communicate respectfully
  • Meet in safe, public locations
  • Check all items before swapping
  • Comply with all applicable laws
  • Resolve disputes directly with the other user

Users are fully responsible for their online and offline interactions.

4. User Content

By uploading photos, text, or other content ("User Content"), you:

  • Retain ownership of your content
  • Grant Swappka a non-exclusive, worldwide, royalty-free license to display and distribute it
  • Confirm you have rights to upload the content and that it does not violate third-party rights

Swappka may remove content that violates these Terms.

5. Prohibited Financial Transactions

Swappka is intended solely for non-financial item swapping. Users are strictly prohibited from:

  • Offering items in exchange for money
  • Requesting money for any listed item
  • Engaging in monetary payment, crypto payment, or any financial transaction
  • Using the platform to sell goods

Any attempt to swap items for money may result in account suspension or removal of content.

6. Swap Process & Disclaimer

All swaps are arranged directly between users. Swappka does not guarantee:

  • Quality, condition, legality, or authenticity of items
  • Accuracy of item descriptions
  • Reliability or behavior of users
  • Success of any swap

All swaps and meetings occur at the user's own risk.

7. No Liability for Meetings or Interactions

Swappka is not responsible for:

  • User behavior, conduct, or identity
  • Loss, damage, injury, or disputes during user meetups
  • Fraud, misrepresentation, or disagreements
  • Any offline consequences

Users are fully responsible for their personal safety.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Swappka is not liable for any direct, indirect, incidental, or consequential damages
  • The Service is provided "as is" and "as available"

This includes issues involving swaps, user conduct, item condition, data loss, or service interruptions.

9. Indemnification

Users agree to indemnify and hold Swappka harmless from any claims, losses, damages, or expenses arising from:

  • Use of the Service
  • Interactions with other users
  • Uploaded content
  • Violation of these Terms or laws

10. Account Termination

Swappka may suspend or terminate accounts for:

  • Illegal activity
  • Fraud
  • Abusive behavior
  • Violations of these Terms

Content may be removed without notice.

11. Changes to Terms

Swappka may update these Terms. Continued use indicates acceptance of the updated version.
